Is it legal malpractice if my attorney ignores my phone calls?
While your attorney is legally obligated to update you on your case whenever something new develops, it is generally not legal malpractice if he does not answer your calls. Of course, this is rude and unethical, and no good attorney would ignore his or her client’s phone calls. However, you will most likely not be able to sue your attorney for doing so.
Is having a conflict of interest considered legal malpractice?
Not always, but oftentimes, it is, as long as you can prove that the conflict of interest either lost you your case or otherwise impacted the outcome of your case negatively.
Can my attorney tell anyone what I tell him?
Absolutely not. Attorneys have a duty of confidentiality towards their clients. Anything a client tells his or her attorney does not leave the room.
Do I have a valid legal malpractice claim?
As long as you can prove that the attorney owed you a duty of care, breached his or her fiduciary duty, and that your case was lost as a result and you incurred significant damages, you should be able to sue your attorney. You will have to prove that had you had a reasonable attorney who did not breach his fiduciary duty, you would have won your case.
