What Happens When an Attorney Neglects to File a Tort Claims Notice?

If you are someone who has recently sustained an injury on government property, or at the hands of a negligent government employee and sought financial compensation to help you heal, you are most likely aware that your attorney had to file a tort claims notice. Tort claims notices are nothing more than simple formalities that inform a government agency that you are going to be filing a lawsuit against it. Though this may be perhaps the simplest part of the claims process, if your attorney forgot to file such a notice, there is a very good chance it drastically hurt, if not totally eliminated your chances of winning your claim.
Attorneys in New Jersey are required, by law, to file tort claims notices after various accidents involving government property or government employees, including the following:
- Sustaining an injury in a public school
- Sustaining an injury due to a broken or defective traffic light
- Slipping and falling, sustaining injuries due to defective street lights owned by a municipality
- Sustaining an injury at a post office or a Social Security Office
- Accidents due to unsafe sidewalk conditions when that sidewalk was owned by a municipality
- Sustaining an injury in mass transit
- Sustaining an injury on any other facility under the control of the county, city, or state
When attorneys in New Jersey do not file tort claims within 90 days of an accident, their clients are generally barred from suing as a result. This is unacceptable.
