The new coronavirus (COVID-19) has had a significant impact on all of our lives, whether directly or indirectly. Just another facet of the impact this pandemic has had now includes court closures for all “non-essential” legal proceedings in the state of New Jersey. On March 18, it was announced that all Superior Court proceedings will be halted indefinitely. How Do Court Closures Impact My Case?
To start, we believe it necessary to inform you that the only exceptions to these court closures are ongoing trials and limited emergencies. In the past month, we have seen the adjournment of civil commitment hearings, in addition to the suspension of grand juries in New Jersey courts. Furthermore, municipal courts are also suspended as of now. Therefore, anyone who is scheduled to appear in the municipal court should instead wait to receive notice of a new court date.
You should also note that in response to the recent pandemic, United States Chief District Judge Freda L. Wolfson adjourned civil and criminal trials scheduled to start in New Jersey’s federal courts before April 30, as well as jury selection for those trials, will be rescheduled at a later date. Additionally, individual judicial officers can continue to hold conferences, sentencing, hearings, change of plea hearings, and bench trials. That being said, these officers are all encouraged to do so via telephone or videoconferencing to stymie the spread of COVID-19.
