Can I Sue a Lawyer For Failing to Address a Lien?

When you hire a lawyer to represent you in, say, a personal injury matter and that attorney wins your lawsuit, he or she must consider all outstanding liens you have. A lien is a payment made to someone you are indebted to. Once you pay that debt, you can keep the rest of the settlement money you won in your claim. That being said, if your attorney fails to take these liens into account, you may suffer significant financial hardships, as a result. This is inexcusable, and can very well be considered a form of legal malpractice. Do not let an attorney get away with this. Simple read on and reach out to our knowledgeable New Jersey legal malpractice attorney today to learn more about what our firm can do for you.
What are the different types of liens?
There are many different types of liens, some of which are as follows:
- Medicaid/Medicare liens: Personal injury attorneys are often legally obligated to pay back their clients’ Medicaid and Medicare liens for the money expended on federally-subsidized healthcare treatment for their injuries.
- Child support liens: When a client is behind on his or her child support agreement and wins a settlement in a personal injury claim, part of that settlement will have to go directly to that client’s former spouse/partner with whom he has a child, or to the state child support collection agency.
- Doctor’s liens: In certain situations, after winning a lawsuit, people will have to pay doctor’s liens when medical providers or services imposed them against the proceeds of the personal injury case.
You should also note that attorneys must always address workers’ compensation liens, as well as letters of protection. If you believe you have a legal malpractice case against an attorney for failing to address and of the aforementioned liens, please do not hesitate to give our experienced New Jersey legal malpractice attorney a call today.
