A no-fault divorce may be granted in many states if you and your spouse have remained separated for a certain required period of time. Such a divorce does not require you to prove anybody’s fault during the marriage, but rather only requires that you remain separated, living in different homes, for the requisite time period. Generally, you must also show that there is no prospect of reconciliation. Some states require that you demonstrate or plead that there was an irretrievable breakdown in the relationship.
